Daniel Penny found not guilty in chokehold death

A Marine veteran has been found not guilty in the deadly New York City subway chokehold case.

The judge first dismissed the manslaughter charge Friday after the jury was deadlocked and then the jury on Monday found Daniel Penny not guilty of criminally negligent homicide. Penny put Jordan Neely in a deadly subway chokehold last year because Penny says he was threatening passengers. Prosecutors say he held the chokehold way too long, There was a mix of cheers and jeers when the verdict was read. Neely's father Andre spoke out afterward.

"Really really hurts. What are we going to do people. What is going to happen to us now. I have had enough of this. The system is rigged.

The attorney for Neely's family expressed optimism that they will get justice through a civil lawsuit against Penny. He said the jury let them down.
