Daniel Penny leaves Manhattan Criminal Court on Friday in New York.

The Marine veteran who has gained national attention for a deadly New York City subway chokehold seen widely on video was arraigned today. Daniel Penny pleaded not guilty to two charges.

Following the arraignment, The Attorney For Daniel Penny, Thomas Kaniff expressed confidence that Penny will be cleared of manslaughter and criminally negligent homicide charges.

"Danny acted reasonably under very difficult circumstances and in a confined environment that none of us would every want to find ourselves in"

Penny is free on bail in connection to the deadly subway chokehold death of Jordan Neely on May Fist. Penny claims Neely was threatening subway riders before he took action. The Neely family attorney Donte Mills says Penny took a life and criticized his court appearance.

"Daniel Penny did not have the courage to look Mr. Jordan's father, Andre in the eyes."
